What if My Vehicle is Damaged When Towed?

If your car has been towed for any reason, and upon locating it you find that it has been damaged, there can be many things for you to clear up. The most prominent question you should have is what do you do if your vehicle was damaged during the tow process?

First thing first is to document the proof of the incident as best as you can. Take photos of the damage either using a camera phone or a disposable camera you left in your glove compartment for that reason. While on the tow lot, speak to the cashier and explain the situation. For each vehicle hauled away, tow companies typically fill out forms prior to the tow that indicate if they notice any physical damage on the vehicle before they move it. Ask the cashier for this paperwork, show her the proof of the damage compare it to their notes and they will most likely file a claim with their insurance company and reimburse you for the damage.

What if you discover the damage on your vehicle only after you drive the car off the tow lot? Bring your car to your mechanic and have them make a full inspection of the vehicle. If the damage was caused by the tow hook, there are specific tell-tell signs they will notice and can document to build your case. Make copies of all the paperwork and speak directly to the tow manager or supervisor in order for them to make good on your claim. If they are not receptive about your claim, you can make a legal claim against them in your local court system.If at all possible, try to avoid putting in a claim with your insurance company as you may find that even though the damage was not your fault, the claim may be against you and can possibly raise your insurance rates.

The most important thing to remember is to be calm if your vehicle is damaged when towed. By handling the situation in a more effective manner, you may be able to come to a resolution without having to take further legal steps. Accidents can happen from time to time, but it’s important that you still have towing coverage for your auto insurance policy.
